Privacy Policy

How NoirGen LLC handles information across the software, website, checkout, and support communications.

NoirGen LLC designs the Software to run locally. Your DAW communicates with a small server on your own machine, and NoirGen does not operate a cloud account for the Software or collect your prompts or audio through NoirGen servers as part of normal Software operation.

For the NoirGen website and web demo, NoirGen may process limited account, session, and security information needed to provide demo access, authenticate users, enforce weekly demo usage limits, prevent abuse, and communicate about account verification, password resets, billing, or support.

If you connect the Software to a third-party AI provider, such as Replicate, using your own API token, that provider may process your prompts, request parameters, and generated audio under its own terms and privacy policy.

NoirGen is not directed to children under 13, or the age of digital consent in the applicable region. If you do not agree with this policy, do not install or use the Software or create a NoirGen demo account.

Data Collection

What may exist locally on your machine, and what may be collected through the website, checkout, or support.

Software and local machine data

  • Prompts and generated audio are processed on your computer and, if you choose, by a third-party AI provider.
  • If you configure a third-party API token, such as in server/.env, it is stored on your machine and used from your machine.
  • NoirGen does not receive or store your third-party API token on NoirGen servers.
  • The local server may save generated .wav files and small .json metadata in local output folders to speed up repeat requests.

Website, order, and support data

  • Contact information you submit, such as name and email address.
  • Order, billing, and transaction metadata needed to complete purchases and respond to billing issues.
  • Routine website technical logs, such as IP address, user agent, browser information, and basic analytics.
  • Support emails, screenshots, logs, and troubleshooting details you voluntarily provide.

Cookies & Analytics

Website analytics are separate from the Software's local-first operation.

NoirGen does not operate analytics or telemetry in the Software. If the website uses cookies, analytics, session tools, or similar technologies, those tools apply to the website experience itself and may be used for security, traffic measurement, checkout continuity, and performance monitoring.

Payments

Checkout processing, taxes, order acceptance, and digital delivery.

Purchases may be processed through Lemon Squeezy. By submitting an order, the customer authorizes NoirGen and/or its payment processor to charge the selected payment method for the amount shown at checkout, including applicable taxes.

An order is not accepted until NoirGen provides an order confirmation or otherwise makes the Digital Product available. Delivery may occur by license key, download link, email delivery, access page, or another method chosen by NoirGen.

Prices are shown at checkout, may change for future purchases, and do not affect already accepted orders. NoirGen may decline, cancel, or place an order on hold if it reasonably suspects fraud, unauthorized payment activity, abuse, or policy violations.

Third-Party Services

Optional AI providers, payment processors, infrastructure, and other external services.

Some NoirGen functionality may require or work better with a third-party service, such as an AI inference provider like Replicate, using credentials or tokens that you supply. Third-party services are not operated by NoirGen unless explicitly stated.

Your use of any third-party service is governed by that provider's own terms, privacy policy, pricing, fees, rate limits, service availability, and compliance rules. You are responsible for your own accounts, tokens, and third-party fees.

Changes or outages involving third-party services, including pricing changes, API changes, model changes, latency, rate limits, discontinuation, or account standing, do not automatically mean NoirGen failed to deliver the Software.

User Rights

What you can do directly

  • Delete local cache, outputs, and metadata stored on your own machine.
  • Remove the Software at any time.
  • Avoid external processing by not connecting NoirGen to a third-party AI provider.
  • Revoke your third-party API token through the provider if you believe it has been compromised.

Requests for data we control

  • Request access to personal information tied to orders, support, or website submissions.
  • Request correction of inaccurate contact or order information.
  • Request deletion where applicable law provides that right.
  • Identity verification may be required before completing certain requests.
NoirGen does not currently maintain a centralized Software user database for normal local operation. If cloud features are introduced later, this page and the linked legal documents will be updated accordingly.

Website Terms of Use

Rules for NoirGen web demo accounts, anti-abuse enforcement, and fair use of shared AI generation resources.

The NoirGen website demo is provided for evaluation, testing, and limited preview access to NoirGen technology. By creating or using a NoirGen web demo account, you agree to use the demo only in a lawful, authorized, and non-abusive manner.

Permitted demo use

  • Create and use one personal demo account for evaluation and testing purposes.
  • Use the demo manually through the website interface within the published weekly usage limits.
  • Use the demo to evaluate NoirGen before deciding whether to purchase the full plugin through Lemon Squeezy.
  • Maintain accurate account information and complete email verification when requested.

Prohibited activity

  • No bots, automated account creation, scripted signups, or other attempts to mass-create accounts.
  • No scraping, no automation, no scripts, and no automated generation requests against the demo.
  • No bypassing, probing, or attempting to circumvent weekly demo limits, rate limits, cooldowns, or account controls.
  • No creating multiple accounts to evade demo restrictions, enforcement actions, or fair-use limits.

NoirGen may apply reasonable safeguards to protect shared AI generation resources, platform integrity, performance, and availability for legitimate users. This includes authentication checks, account verification requirements, request throttling, usage limits, cooldowns, abuse detection, and similar controls.

NoirGen may suspend, restrict, or terminate demo access, refuse requests, or block accounts or traffic that appear abusive, automated, fraudulent, excessive, evasive, or otherwise harmful to the service or other users.

The web demo may be modified, rate-limited, suspended, or discontinued at any time, with or without notice. Demo availability, supported features, output quality, model access, and usage allowances may change at any time.

Demo signup is only for access to the NoirGen web demo. Plugin purchases are handled separately through Lemon Squeezy, and purchase-related legal terms remain available below on this same /privacy page.

EULA

A concise summary of the current End User License Agreement.

NoirGen is licensed, not sold. Subject to payment of applicable fees, NoirGen grants a non-exclusive, non-transferable, non-sublicensable license to install and use the Software solely to create or assist in creating audio content.

Unless an order states otherwise, the current EULA allows a single user to install the Software on up to two devices the user owns or controls.

Output may generally be used in personal or commercial projects, but the user remains responsible for prompts, third-party service usage, rights clearance, and compliance with law. NoirGen does not guarantee perfect loops, artifact-free audio, error-free output, or any specific creative result.

The EULA also restricts reverse engineering, redistribution, hosted use, and unlawful use; includes an "as is" warranty disclaimer; limits liability; and sets governing law and venue in New Jersey, USA.

Refund Policy

Digital delivery rules, final-sale terms, limited exceptions, and chargeback handling.

The simple rule is straightforward: NoirGen is a downloadable digital product, so all sales are final once the Software is delivered or used, except where applicable law requires otherwise.

"Delivered" occurs at the earliest of issuing a license key or access credential, providing a download link, otherwise making the Software available, initiating a download, or activating, installing, or otherwise accessing the Software.

Not refundable

  • Creative dissatisfaction, change of mind, or not liking the sound, style, or quality of output.
  • Output that is not perfectly looped every time or contains artifacts or timing issues.
  • Incompatible systems, unsupported environments, setup mistakes, missing requirements, or user error.
  • Third-party AI provider issues, including outages, token problems, API changes, pricing changes, rate limits, or account issues.

Possible limited exceptions

  • Duplicate purchase or billing error.
  • Software that is completely non-functional on a supported system and cannot be fixed or reasonably worked around after good-faith troubleshooting.
  • Refunds required by consumer law in the customer's jurisdiction.
  • Requests for the non-functional exception generally require contacting support within 7 calendar days after delivery and cooperating with troubleshooting.

If NoirGen cannot provide a fix or reasonable workaround within 14 calendar days after acknowledging a qualifying support request in writing, a refund may be considered where permitted by law. Customers should contact support before initiating a chargeback. Unwarranted chargebacks may lead to suspension or revocation of the license during review.

Terms of Sale

The NoirGen plugin is purchased separately from the web demo. Purchases are processed through Lemon Squeezy or another checkout controlled by NoirGen, and the applicable order is governed by the Terms of Sale together with the EULA and Refund Policy.

The Purchase Terms explain ordering, payment authorization, taxes, digital delivery, fraud checks, third-party checkout processing, and how purchases interact with licensing and support. They also clarify that plugin purchases are distinct from demo signup.

For consistency across NoirGen legal materials, the Purchase Terms use the same company information and governing law framework shown on this page, with visible references normalized to New Jersey, USA.

Trademark

How the NoirGen name, logo, and related branding may be referenced.

"NoirGen," the NoirGen logo, and related marks are trademarks of NoirGen LLC. You may make truthful descriptive references such as compatibility statements or editorial references, but you may not imply endorsement, affiliation, sponsorship, or ownership by NoirGen unless NoirGen gives written permission.

Do not use NoirGen trademarks or logos in a product name, company name, domain name, social handle, paid ad, or application branding in a way that could cause confusion. Logo use requires written approval from NoirGen.

NoirGen may update these legal materials from time to time to reflect product changes, operational changes, clearer drafting, or legal requirements. The "Last updated" date indicates when the latest version became effective for new users, new demo accounts, or new purchases.

For existing purchases, the version in effect at the time of purchase generally applies unless a later change is required by law or is more favorable to the customer.

If NoirGen later introduces cloud features, centralized accounts, additional data practices, or new commercial offerings, this page and the linked legal documents will be updated accordingly.
